By accessing or using ImageGPT ("the Service"), available at https://imagegpt.org, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.
These Terms constitute a binding agreement between you ("User" or "you") and ImageGPT ("we", "us", or "our").
Key definitions:
2.1. ImageGPT provides access to AI-powered tools for generating photos, videos and music from text prompts and uploaded media.
2.2. The Service is provided on an "as-is" basis. We do not guarantee uninterrupted availability and are not responsible for the quality of AI-generated content, as results are determined by third-party algorithms.
2.3. You accept that use of generated results is entirely at your own risk.
2.4. The agreement is considered entered into when you perform any of the following actions: creating an account, purchasing credits, or using the Service functionality.
3.1. You agree to provide accurate information when using the Service.
3.2. You must not resell, sublicense, or redistribute the Service or its underlying technology.
3.3. You must not generate content that violates applicable laws, infringes third-party rights, or contains sexual violence, extremism, or other prohibited material.
3.4. You must not share access to your account with third parties.
3.5. You confirm that you understand and accept these Terms in full.

Generation costs: standard image — 1 credit, HD — 2 credits, 4K — 4 credits; enhancement and background removal — 1 credit; face swap — 2 credits; AI portrait — 3 credits; video and music — as per rates on the Site.
4.2. All payments are processed via Stripe. We accept Visa, Mastercard, and other major payment methods.
4.3. Credits do not expire and are not subject to auto-renewal unless you have an active subscription.
4.4. Refunds are available for unused credits within 14 calendar days of purchase. To request a refund, contact support@imagegpt.org.
4.5. Credits used for generation are non-refundable regardless of the subjective assessment of result quality.
4.6. All refunds are net of actual processing costs including payment processor fees.
5.1. All rights to the Service platform and its components belong to ImageGPT.
5.2. Content you generate using the Service may be used by you for personal and commercial purposes, unless otherwise restricted by the terms of the third-party AI models used.
5.3. You may not decompile, reverse-engineer, or modify the Service software.
5.4. We may use generated content in anonymised form to improve the Service and for marketing purposes, unless you opt out in your account settings.
6.1. We are committed to protecting your personal data in accordance with our Privacy Policy.
6.2. Files you upload (photos, videos, audio) are used solely to perform the requested generation and are not shared with third parties except as required by law.
7.1. We shall not be liable for indirect, incidental, special, consequential, or punitive damages.
7.2. Our total liability shall not exceed the amount you paid for credits in the 30 days preceding the claim.
7.3. We are not responsible for actions you take with generated content or for damages caused to third parties as a result.
8.1. Neither party shall be liable for failure to perform obligations due to circumstances beyond their reasonable control (force majeure).
9.1. We reserve the right to modify these Terms at any time. Updated Terms will be posted on the Site and take effect immediately.
9.2. Continued use of the Service after changes constitutes acceptance of the updated Terms.
